Terms & Conditions

Effective date: April 1, 2023

1. Agreement

By registering your child for the Pre-season Player Evaluation Academy Camp (here in after referred to as "the Camp"), organized by coach better AG (hereinafter referred to as"the Organizer"), you (hereinafter referred to as "the Participant" or "the Parent/Guardian") agree to be bound by the following terms and conditions.

2. Camp Details

  • The Event details, including date, time, location, and program, will be provided in the event-specific materials.
  • The Participant must meet any age or other eligibility requirements specified for the Event.

3. Waiver of Liability

  • With the acceptance of these Terms and Conditions, the Participants or Parents/Guardians acknowledge that the training and activities involved during the Events may involve the possibility of injury or death or property damage and that medical facilities may not always be readily available during the Events.  
  • With the acceptance of these Terms and Conditions, the Participants or Parents/Guardians expressly accept these risks, and all other risks whether known or unknown at this time arising from these Events.
  • With the acceptance of these Terms and Conditions, the Participants or Parents/Guardians understand that the applicable rules for participation must be followed and that sole responsibility for the personal safety remains with the Participant, including the physical and emotional preparation and fitness to participate in the Event.
  • With the acceptance of these Terms and Conditions, the Participants or Parents/Guardians hereby give a FULL RELEASE AND WAIVER OF LIABILITY AND ALL CLAIMS that they have, or may have in the future, against the Organizer or its vendors, contractors, including those organizing, officiating, or participating in such Events, and their respective officers, directors, employees, agents, servants, volunteers and representatives (the “Releasees”), from all liability for any loss or damage to property, injury or expense that the Participant or Parent/Guardian may suffer as a result of the participation in any part or arts of the Event or the presence at any venue at which they may take place, due to any cause whatsoever, including negligence, breach of contract or statutory duty or other duty of care.
  • With the acceptance of these Terms and Conditions, the Participants or Parents/Guardians AGREE NOT TO SUE and further agree TO INDEMNIFY AND HOLD HARMLESS the Releasees from all expenses, fees, liability or damage award or cost of any type whatsoever arising from the participation in the Event, in particular arising from or in connection with (i) breach of contract on the Participant’s or Parent’s/Guardian’s part, and (ii) negligence, or willful or intentional misconduct on the Participant’s or Parent’s/Guardian’s part during the participation in the Event. For the avoidance of doubt, the Participants or Parents/Guardians agree to be liable for any damages to any third party caused during the Events save for where such damage is caused by wilful misconduct or negligence of the Releasees.

4. Medical Authorization

  • The Participant is required to be in good health without having pre-existing medical conditions that render him/her unsuitable for participation at the Event.
  • The Participant or Parent/Guardian hereby authorizes the Organizers to seek and obtain medical treatment for the Participant in case of illness or injury if they are unable to contact the Parent/Guardian in a timely manner. All medical expenses incurred will be the responsibility of the Participant or Parent/Guardian.

5. Code of Conduct

Participants and Parents/Guardians are expected conduct themselves in a respectful manner and to adhere to the Camp's code of conduct, which includes respecting coaches, staff, fellow participants, and facility rules. Any misconduct may result in the Participant's expulsion from the Camp without a refund.

6. Registration and Payment

  • Participants must register for the Event by the specified deadline and pay the registration fee in full.
  • All payments are non-refundable, except as specified in the Cancellation and Refund Policy (Section 8).

7. Event Changes and Cancellation

  • The Organizer reserves the right to make changes to the Event, including its date, time, location, or program, or to cancel the Event for any reason.
  • In the event of cancellation by the Organizer, registered Participants or Parents/Guardians will receive a refund in accordance with the Cancellation and Refund Policy (Section 8).

8. Cancellation and Refund Policy

  • Cancellation requests must be submitted in writing to info@coachbetter.com at least 30 days before the Camp start date to be eligible for a refund.
  • A non-refundable deposit of $100 may be retained for all cancellations.
  • If the cancellation request is received after the specified deadline, no refunds will be issued.
  • The Organizers reserve the right to cancel the Camp for any reason. In the event of cancellation by the Organizers, a full refund will be provided to registered Participants or Parents/Guardians.
  • In the event that a Force Majeure Event leads to the cancellation, postponement, or material alteration of the Camp, the Organizer shall not be obligated to provide refunds to the Participants or Parents/Guardians.
  • For the purposes of these Terms and Conditions, a "Force Majeure Event"shall mean any unforeseeable event beyond the reasonable control of the organizing party that makes it impossible or impractical to perform the obligations. This includes but is not limited to shortage of labour, energy, raw material or supply, strikes, lock outs, natural disasters, acts of nature, epidemics and pandemics, war and terrorism, acts of government, acts of God or any other hindrances beyond the control of the Organizers.

9. Photography and Recording Release

The Participant or Parent/Guardian grants permission for the Organizers to use photographs, videos, or likenesses of the Participant for promotional and marketing purposes without further consent or compensation.

10. Governing Law

This agreement shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

11. Entire Agreement

These terms and conditions constitute the entire agreement between the Participant or Parent/Guardian and the Organizer regarding the Camp and supersede all prior agreements, whether oral or written.

By registering for the Camp, the Participant or Parent/Guardian acknowledges that they have read and understood these terms and conditions and agree to abide by them.
